Terms of Use

1. Agreement and operator

These Terms govern Character Studio’s iOS app and related services. Your agreement is with Jolly Bhagat, an individual based in India, at Jolly Bhagat, New Grain Market, Kothi No. 6, Khasra No. 9, Opposite Market Committee, Patiala 147004, Punjab, India. Contact support@vivarium-legal.com. By using the service you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, discontinue use.

Users must be at least 13. If you are below the age of legal majority, obtain a parent or guardian’s permission. Portraits submitted for AI processing must depict adults.

2. Stories, images and videos

The iOS app offers authored role journeys, story choices, AI-generated character portraits and ending scenes, and optional videos. Available features, templates and costs are shown in the app.

AI results can be inaccurate, unexpected, non-unique or inconsistent with your likeness and choices. Availability, completion time, identity continuity and a particular artistic result are not guaranteed. Review results before using or sharing them. A technically completed job is distinct from your subjective approval.

3. Accounts and access

You may begin with a guest account and use Sign in with Apple where available. Keep your device and account access secure. Local project files are associated with the current account on that device; do not assume a guest account or local project will be recoverable on another device. Link the correct account before switching when the app requests it.

Subscription restoration and account transfers are subject to verified Apple purchase records and the service’s account checks. One subscription has one active account ownership at a time. Restoring or switching accounts does not create duplicate credit grants or turn a consumed credit pack into a new purchase.

4. Your content and permissions

You retain the rights you already hold in content you submit. You must have the necessary copyright, likeness, privacy and other permissions to upload and process it, including permission from identifiable people where required. Submit only adult portraits you are authorized to use.

You grant us and our service providers a limited permission to store, transmit, reproduce, transform and process your submitted content as necessary to deliver your requested creation, operate and secure the service, and address your support request. This permission does not grant a general advertising or model-training license. Retention and deletion are described in the Privacy Policy.

5. Output, classical characters and sharing

You may save and share available results, subject to rights you hold, applicable law and third-party restrictions. We do not promise that every AI output qualifies for copyright, is exclusive, is free of third-party rights, or is cleared for every commercial use. You are responsible for assessing permissions for your intended use.

Classical mythology and historical literary concepts do not grant rights to modern adaptations, film or game designs, actors’ likenesses, trademarks, translations or other protected material. Character Studio’s original stories and artwork are not a license to those third-party works. Do not present a fictional or generated scene as an authentic recording of someone’s conduct.

6. Apple purchases, subscriptions and credits

The app’s purchase screen and Apple’s confirmation show the product, localized price and subscription period. Credit amounts and applicable allocation rules are described in the app before purchase. Review these details before buying. Apple processes payment. Auto-renewable subscriptions renew according to the displayed App Store terms unless cancelled through Apple. Subscription credits are allocated for each applicable period. Unused subscription credits expire at the end of that allocation period and do not roll over. One-time credit packs are accounted for separately from monthly subscription allocations. The app’s current balance and creation estimate determine whether a new request can start; selecting a different creation can require additional credits.

Credits are service units, not cash or a general payment instrument. A disappointing result does not by itself establish a failed job. If a request or balance is unclear, contact support so the original job and charge can be reconciled before submitting another request. Applicable consumer rights remain available.

Restore Purchases checks eligible active Apple subscriptions for the correct Apple Account and Character Studio account. It does not restore consumed one-time packs or award the same credit grant twice. Apple controls subscription cancellation and App Store refund requests; use Apple refund requests. Deleting the app or Character Studio account does not cancel a subscription.

7. Acceptable use

Do not use the service to infringe copyright, privacy or likeness rights; submit child portraits for AI processing; create sexual content involving minors or non-consensual sexual imagery; impersonate, defraud or deceptively portray another person; harass, threaten or abuse others; create or distribute unlawful content; evade safety controls; access another account’s content; or interfere with the service’s security or operation.

We may refuse content or restrict access when reasonably necessary to enforce these rules, protect people or the service, or comply with law and provider restrictions. Where required, we will provide notice and available review options. Contact support if you believe a restriction is mistaken.

8. Closure and service changes

You can close your account using Account → Delete Account. Consult the Privacy Policy for local cleanup, retained records and deletion requests. Export any available creations you want to keep before closing the account. Cancel an Apple subscription separately.

We may update, suspend or discontinue features for operational, security or legal reasons, subject to applicable law and your mandatory purchase and consumer rights. We will give notice where required. Changes remain subject to the purchase terms confirmed by Apple and applicable consumer law.

9. Apple terms and third parties

The iOS app license is subject to Apple’s Standard Licensed Application End User License Agreement where applicable. Apple is not the operator of Character Studio. Purchases and third-party services may also be governed by their own applicable terms. BytePlus processes AI inputs and outputs as described in the Privacy Policy.

10. Responsibility and governing law

Use reasonable care in choosing inputs and reviewing outputs. To the extent permitted by applicable law, we do not warrant uninterrupted or error-free service, the accuracy of AI output, or suitability for a particular purpose. Nothing in these Terms excludes or limits liability or rights that cannot lawfully be excluded or limited, including mandatory consumer remedies.

These Terms are governed by the laws of India, subject to any mandatory protections available under the law of your residence. You retain any right to bring a claim in a local court or other forum that applicable law gives you. For an issue, contact support@vivarium-legal.com so we can seek a practical resolution; doing so does not waive statutory rights or deadlines.
